California landlords, a new law, AB 2801, is set to change how you handle security deposits in 2025 going forward. These updated regulations aim to increase transparency during move-ins and move-outs by requiring photo documentation of the rental unit’s condition.

If you’re a landlord in California, there’s an important new law you need to know about: AB 2801. Starting in 2025, California’s introducing new security deposit regulations that affect how you handle move-ins and move-outs with tenants.

AB 2801 and Security Deposit Deductions

Starting April 1st, 2025, landlords must photograph rental units after tenants move out and before any cleaning or repairs. This helps document the condition of the property, ensuring you’re ready if you need to justify any security deposit deductions.

Then, beginning July 1st of 2025 for new tenancies, landlords must also photograph the unit before the tenant moves in.

You’ll need to provide tenants with date-stamped photos for both move-in and move-out and any photos taken after repairs or cleaning. This way you’ll have clear evidence to support any deductions from the security deposit.

Carpet Cleaning

Now, when it comes to security deposit deductions, there is something crucial to note. Deductions for carpet cleaning are only allowed if it’s necessary to restore the carpet to its original condition, minus any normal wear and tear.

These new rules are designed to protect both landlords and tenants, but they also require you to be thorough and proactive.
