The ordinance, effective March 14, 2024, creates restrictions on Santa Monica rent increases. Bad faith, excessive rent increases are now expressly prohibited. The ordinance applies to properties that are not already rent controlled apartments.

The city of Santa Monica has implemented a prohibition against bad faith, excessive rental increases. What does that mean?
It means if the landlord decides to increase the tenant’s rent beyond the market’s rates for a comparable unit, with the intent to vacate the tenant through fraud, intimidation, or coercive means, then the tenant may raise an affirmative defense towards their eviction action.
What is evidence of bad faith? Evidence of bad faith is if a landlord increases the tenant’s rent within six months of an unsuccessful just cause eviction, or if the landlord increases the tenant’s rent within six months of the tenant filing a complaint with the health department or with the housing department.
Additionally, if there’s a rental increase imposed when price gouging protections are in effect. These are some of the things to watch out for whenever you’re looking to increase your tenant’s rent.
